Welcome to dmforcollab. These Terms of Service ("Terms") govern your use of the platform at dmforcollab.com. By creating an account or completing a booking, you agree to these Terms.
1. Who can use the service
- Creators — the platform is built exclusively for influencers and public-facing content creators who earn through an audience on Instagram, YouTube, X, TikTok, Twitch, podcast platforms, or regional-language networks.
- The service is not intended for licensed professionals offering regulated services (doctors, lawyers, chartered accountants). You agree not to list sessions that require professional licensure.
- You must be at least 18 years old to create a creator account.
- Fans can book any public creator page without creating an account.
2. Your account
- You are responsible for keeping your credentials confidential.
- You must provide accurate KYC information (PAN + phone OTP) for payouts via Cashfree.
- One person = one creator account. Multiple accounts for the same individual may be suspended.
- We may suspend or terminate accounts that violate these Terms, applicable Indian law, or our acceptable use policy (Section 5).
3. Services you list
- You set the title, description, duration, and price for every service. Minimum price is ₹100 per booking.
- Each service must include at least 2 benefits describing what the fan walks away with. Benefit descriptions must be accurate and deliverable.
- You agree to honor every confirmed booking by joining the scheduled Google Meet at the booked time.
- You are solely responsible for the content, legality, and quality of the sessions you deliver. We are a platform, not a party to the call.
4. Payments, fees, and payouts
4.1 Platform fee
We charge a flat 8% platform fee on every successful booking. Creator Pro subscribers (₹499/month) receive a 0% platform fee. Payment gateway fees (~2% charged by Cashfree) are passed through to the fan at checkout and are not our revenue.
4.2 Escrow-style hold
Fan payments are held by Cashfree until session completion. Creator payouts are released weekly to the bank account linked during KYC.
4.3 Refunds and disputes
- Fans may raise a dispute within 24 hours of the scheduled session time via the dispute email sent with every booking confirmation.
- If the creator fails to show up, the booking is automatically refunded in full.
- If the fan fails to show up after being notified (24h + 1h reminders), the session is considered delivered and no refund is issued.
- For quality disputes, we review fairly and may refund partially or in full at our discretion. Our decision is final.
4.4 Taxes
You are responsible for reporting income from the platform and paying applicable GST and income tax under Indian law. We issue a monthly earnings statement for record-keeping.
5. Acceptable use
You agree not to use the platform to:
- List illegal services, adult content, or services involving minors.
- Deceive fans about what a session includes.
- Harass, threaten, or discriminate against any fan.
- Circumvent the payments system by asking fans to pay outside the platform.
- Scrape data, reverse-engineer the platform, or abuse rate limits.
- Upload malicious code, spam, or content that infringes intellectual property rights.
Violations may result in warning, feature limits, account suspension, or permanent ban, along with forfeiture of pending payouts in serious cases.
6. Intellectual property
- You retain ownership of all content you upload — avatar, cover, bio, benefits, testimonials.
- By uploading, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content only as necessary to operate the service.
- We retain all rights to the platform itself — templates, layouts, the dmforcollab brand, source code. You may not redistribute these without written permission.
7. Third-party services
The platform integrates with Cashfree, Google (OAuth, Calendar, Meet), WhatsApp Business (via AiSensy or Gupshup), Instagram Graph API, and YouTube Data API. Your use of these integrations is also governed by their respective terms. We are not responsible for downtime or changes in their services.
8. Termination
- You may delete your account anytime from the dashboard. Pending payouts will be settled on the next weekly cycle.
- We may terminate accounts for material breach of these Terms with at least 7 days' notice — or immediately for fraud, legal risk, or emergency abuse.
- On termination, your public page is taken offline, but booking records are retained per our Privacy Policy Section 5.
9. Disclaimers and liability
The service is provided "as is". We do not guarantee uninterrupted uptime or that every fan will be satisfied. To the maximum extent permitted by Indian law, our total liability for any claim arising out of these Terms is limited to the platform fees you paid us in the preceding 3 months.
10. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
11. Changes
We may update these Terms from time to time. Material changes will be emailed to creators at least 14 days in advance. Continued use after the effective date means you accept the updated Terms.
